Moon is scheduled to begin trial June 12 after being arrested on suspicion of drunken driving in December.

The hearing had been ordered to conduct a review of a negligent-driving sentence placed on Moon in August of 2007. A condition of the August sentence was that Moon have no further law violations and that he submit a blood-alcohol test if stopped by a law-enforcement officer. Moon declined to take a field sobriety test when he was arrested Dec. 28 for driving under the influence.

Moon was arrested around 2 a.m. on Dec. 28, after refusing to take a field sobriety and breath test. He was also cited for expired tabs. A pre-trial hearing is scheduled for March 31.

According to police, Moon was driving an SUV with expired plates when he was pulled over Dec. 28 in Medina, Wa. A police officer smelled "intoxicants" in the vehicle, and Moon refused a field sobriety test and a breath test. He was arrested for investigation of DUI and driving with a suspended license and was released later the same day. Moon is scheduled for arraignment Feb. 5. This is Moon's second alcohol-related incident in the last year. In August 2006, Moon pleaded guilty to negligent driving as a result of a DUI arrest in April.

State records show Washington State Patrol trooper Joe Gannon measured Moon's blood-alcohol level at .068 percent and .067 percent April 6. Both reading are below the .08 legal limit in the state of Washington. The prosecutor's office has not announced if it will file charges. Charges can still be filed even with both tests under the legal limit. The state could try to show that the person was impaired in a manner that made it unsafe for them to drive.
