Jackson's attorney, Cole Casey, plans to appeal the ruling. Casey said he hopes this ends up in the federal court, because they believe Jackson's Fourth Amendment rights were violated through an unreasonable search and seizure. Casey has argued Jackson was forced to have blood drawn against his will after being arrested Jan. 6 on suspicion of drunken driving.

Jackson's attorney said Jackson was forced to have blood drawn against his will after repeatedly requesting a breath test. His blood-alcohol content measured 0.17 percent, according to court records. If the motion carries, the blood test results would be suppressed. He pleaded not guilty to the misdemeanor DUI charges, and his next court date is scheduled for June.
