Santo Domingo judge Freddy Frias ordered him to remain in jail for three months while the case is prepared by prosecutors. Burgos pitched for the Kansas City Royals from 2005-06 and the New York Mets in 2007.

He also said he had been ordered to remain in jail for three months, while waiting for his trial, out of a judge's concerns for his safety. Burgos also maintained that he was not at the wheel at the time of the accident, but was in the back seat, with his cousin driving.
